Melissa Brown and Amanda King of MOODK’s New Jersey Office were successful in obtaining summary judgment dismissing all claims against an oceanfront bar and restaurant.  Plaintiff sought damages for injuries she claimed were causally related to a fall down an exterior stairway.  Our attorneys aggressively attacked Plaintiff’s liability and damages experts.  They were able to establish that Plaintiff had preexisting medical conditions that contributed to Plaintiff’s fall.  We also argued that Plaintiff’s liability expert opinions were unsupported by the factual record and inadmissible at time of trial.  We further argued that Plaintiff could not establish proximate cause as she conceded that she was holding onto the handrail at the time of her fall and her claim that she could have arrested her fall had the handrail been constructed differently, was specious at best.  The trial court agreed and dismissed the lawsuit with prejudice.
