Melissa Brown and Amanda King of our New Jersey office obtained dismissal of a nursing home malpractice case. Plaintiff alleged negligence under New Jersey’s Nursing Home Act. If proven, a violation of the Act would entitle Plaintiff to treble damages as well as attorney’s fees and costs. We filed a Motion to Compel Arbitration consistent with the provisions set forth in the admission agreement. Plaintiff opposed taking the position that the admission agreement was a contract of adhesion and arguing that there was no meeting of the minds. The court granted our Motion and dismissed the Complaint with prejudice.
