After the New Jersey Supreme Court granted the Petition for Certification, New Jersey partner Frances Wang Deveney, Esquire recently argued before the State’s highest court. The issue of first impression involved the existence of a duty of an EMT driver to report a co-worker for alleged sexual abuse committed on a minor the EMT driver did not know. After winning summary judgment at the trial court level, the Appellate Division reversed indicating that there may be a common law duty to report to authorities under the circumstances. The Supreme Court granted certification but has yet to rule on this case.
