Melissa Brown and Melissa Kanbayashi of our New Jersey office were successful in obtaining dismissal of all claims against our client, an outdoor environmental education program.  The case involved sensitive claims brought by a minor child with special needs and his mother.  Our client, a nonresident not for profit, was brought in on third-party claims of negligence.  We filed a Motion to Dismiss taking the position that the court in New Jersey did not have jurisdiction over our client.  The court ordered discovery on the issue of jurisdiction and voluminous briefing ensued.  Ultimately, the court agreed that it did not have jurisdiction over our client and dismissed all claims with prejudice.
