Melissa Brown and Patrick Nemes of the New Jersey office of Marks, O’Neill, O’Brien, Doherty & Kelly, P.C. were successful in securing summary judgment on behalf of our client, a manufacturer of fiberglass and metal furnishings in a product liability case.  This case arose from the collapse of a chair allegedly manufactured by our client.  Plaintiff’s counsel failed to produce an expert report establishing the chair was defectively designed and/or manufactured.  Based on this failure, we argued that without expert testimony plaintiff would be unable to establish that the subject chair was defectively manufactured, or that such defect was the proximate cause of Plaintiff’s injuries.  Ultimately, the court agreed, finding that plaintiff had failed to establish a claim under New Jersey’s Product Liability Act, and summary judgment was granted.
