Michael A. Kosar and Michael V. Slivjak of the New Jersey office of Marks, O’Neill, O’Brien, Doherty & Kelly, P.C. were successful in securing summary judgment on behalf of our client, a licensed professional engineer, in a complex professional negligence matter. The action centered on the preparation of a vibratory pile log and certification, which had been relied upon in the raising of a home following Superstorm Sandy. Following the close of discovery, we argued a strict application of the standard of care developed by the plaintiffs’ expert, specifically with respect to the provisions of the New Jersey Administrative Code governing our client’s services. Ultimately, the court agreed that the plaintiffs failed to articulate any deviation from that standard of care, and summary judgment was granted.
