Melissa Brown of Marks, O’Neill’s New Jersey office was successful in obtaining summary judgment in a wrongful death case. Marks O’Neill defended a medical entity as well as seven medical providers against claims of constitutional violations arising under 42 U.S.C. 1983 as well as medical negligence. Plaintiff was the surviving spouse of an inmate who committed suicide during his incarceration. We argued that Plaintiff failed to establish deliberate indifference by the medical providers and that Plaintiff failed to establish a deviation from the standard of care by the individually named medical providers. The Court agreed and dismissed the claims against our clients in their entirety.
