Plaintiff’s suit alleging that medical delays during her incarceration resulted in her paralysis. Plaintiff sought compensatory as well as punitive damages.
Melissa Brown of our New Jersey office prevailed in a Motion to Dismiss. We argued that Plaintiff’s medical malpractice claims were barred by Plaintiff’s failure to file a Notice of Tort Claim under Title 59. While Title 59 typically applies to governmental entities, the court accepted our arguments that medical providers in correctional settings fall within the protections of Title 59. All claims against all of our clients were dismissed with prejudice.
