Melissa Brown of our New Jersey office was successful in obtaining dismissal of a claim for civil harassment against our client, a condominium association. Plaintiffs, homeowners in the association, filed suit alleging civil harassment arising from citations they received from the association and its property management company. Plaintiffs also sought punitive damages.
A Motion to Dismiss was filed prior to the commencement of any discovery. We argued that New Jersey does not recognize a cause of action for civil harassment outside the context of employment cases. The Court agreed and dismissed the suit for failure to state a claim on which relief can be granted.
