Following a four-week trial in New York Supreme Court, Queens County, a six-member jury deliberated for less than an hour before finding in favor of our client and codefendant pulmonologist.

The action arose from allegations that the insured, a Board certified Internist and Infectious Diseases specialist, negligently treated plaintiff’s decedent during a two-week hospitalization resulting in pulmonary embolism and death. Our client had considered a Deep Vein Thrombosis or Pulmonary Embolism but not ordered any diagnostic tests to rule them out. 

Attorney James M. Skelly successfully challenged every aspect of plaintiff’s claims as to liability and causation.
