On March 12, 2013, James M. Skelly, a partner in the Marks, O’Neill, O’Brien, Doherty & Kelly New York offices, obtained a defense verdict in a medical malpractice and negligence case against a doctor, medical assistant and medical office. The Plaintiff, an elderly woman, who walked with a cane, fractured her hip when she fell off an examination table. The Plaintiff alleged that the defendants’ treatment breached the standard of care and was also negligent, in that they failed to properly assess her as a fall risk and failed to properly supervise her while she was in the examination room. The case proceeded to trial on the negligence claims, only, after Nicole Del Vecchio, an associate in our Manhattan office, was successful in obtaining summary judgment on the the medical malpractice claims. The jury, after a seven day trial, returned a unanimous verdict in favor of all defendants.
