Michael Biniakewitz is Of Counsel with Marks, O’Neill, O’Brien, Doherty & Kelly. He is admitted to practice law in New York.

Michael graduated with honors from St. John’s University in 1997, with a bachelor’s degree in political science. He attended New York Law School, graduating cum laude in 2002. During law school, he was a member of New York Law School’s Immigration Clinic, where he appeared regularly in Immigration Court advocating on behalf of clients seeking asylum in the United States from several war-torn countries and successfully obtained status for several clients through the program.

During law school, Michael also interned at the Nassau County District Attorney’s Office and later went on to accept the assignment of Assistant District Attorney in the Bronx County District Attorney’s Office upon graduating. During his tenure in the Bronx County District Attorney’s Office, Michael prosecuted countless crimes ranging from misdemeanors to most violent felony offenses. Additionally, during his tenure in that office he was named trial supervisor due to his trial experience and success.

Upon leaving the District Attorney’s Office, Michael went on to become an associate with a civil defense firm in New York, where he was able to successfully defend more than a dozen clients through obtaining defense verdicts after trial in just short of two years with the office. Michael left the office to accept the role as a managing attorney in a criminal defense department of a mid-size firm, where he supervised junior associates not only in criminal defense matters but also mentored attorneys handling personal injury matters that varied from premises liability cases to wrongful death matters. In 2012 Michael began his own practice where he was trial counsel for boutique law firms, while also representing his own clients in a broad spectrum of legal matters from murder indictments to representing law firms accused of civil rights violations, with several of the matters he handled gaining media attention.

Since joining Marks O’Neill, Michael brings his experience to the Casualty, Healthcare, Professional Liability, Construction and Transportation practice groups.

Outside of work. Michael enjoys motorcycle track days, traveling to as many countries as he can when he and his wife find time and the occasional Netflix “binge.”
